Terms of Service

These Terms of Service are applicable to all Fusion Academy users (“Users”) that visit or use the websites (the “Websites”) and to anyone who enrolls in any Fusion Academy course (“Course”) Fusion Academy’s “Services” may be used to refer to the use of the Websites or the ability to enroll in a Course.

By using the Websites and/or enrolling in any Courses, a User agrees to these Terms of Service and Fusion Academy’s Privacy Policy and is bound by them. They should not use the Websites or enroll in any Courses if they do not agree to be bound.

Ownership of the website and course materials

Fusion Academy will be considered the owner of all website and course materials and information. Fusion Academy prohibits any rebroadcasting, retransmission or use of the materials without their express written consent.

Fusion Academy has given prior written permission for the User to not sell, distribute, retransmit or post any of the Licensed Materials. Fusion Academy retains all copyrights to the Licensed Materials. The user agrees to use these materials only for personal and professional development.

Participant Consent

The user agrees that Fusion Academy’s Courses may be photographed and audio and video recordings (collectively “Class Recordings”) can be made and broadcast or used for commercial and educational purposes by Fusion Academy (collectively, “Course Rebroadcasts”) by Fusion Academy. Participants who attend or actively participate in Courses irrevocably agree to appearances in Class Recordings or Course Rebroadcasts. They also waive all claims for remuneration related to these Class Recordings or Course Rebroadcasts. Participants in or attending Courses irrevocably give Fusing Academy all rights to any comments or suggestions or other participatory input that might occur during such Courses. This information may be used at Fusion Academy’s sole discretion.

Recorded viewing return and refund policy

Before the User has access to the Course Materials, payment for audio or video courses must be made in advance. There are no refunds for audio and video purchases.

Governing Law and Dispute Resolution

All disputes arising out of or relating to the Services will be governed by these Terms of Service and Fusion Academy’s Privacy Policy. Fusion Academy will work with any User who has a complaint or dispute regarding the Services. User and Fusion Academy will mediate any dispute before a mutually agreed mediator to try to reach a solution. The costs of mediation are shared equally by both parties. User and Fusion Academy both agree that Indian law will govern any dispute that may arise from or relate to this Privacy Policy. All claims arising out of or relating to these Terms or Services will be litigated only in the federal or Indian state courts. They also consent to personal jurisdiction. Fusion Academy may not waive any rights or enforce any terms of these Terms of Service.
